Central planning committee – decisions 4 April 2013

The following planning decisions were made by Shropshire Council’s Central planning committee at its meeting on Thursday 4 April 2013 in Shrewsbury.

Land to rear 110-112 London Road, Shrewsbury – 12/03556/FUL

Erection of three residential dwellings with integral garages; formation of vehicular access following demolition of existing garage.

Decision: Refused – contrary to the Officer’s recommendations, for the following reasons: 

It is considered that the proposed development is unacceptable due the following material considerations. 

  • The detrimental impact on the residential amenity of the adjoining surrounding properties, particularly the overbearing impact of Plot C on no. 108 London Road.
  • The inadequacy and unsuitability of the proposed access to the site, particularly: The proposed width of 3.9m for the access being below the recommended width of 4.1m.
  • The proposed access did not lend itself to ensuring safe access/egress to users at all times.
  • The provision of the proposed access would have a detrimental impact on the provision of adequate parking for existing dwellings on London Road leading to potential adverse impacts on the residential amenity of adjoining occupiers and users of the public highway. 

Accordingly the proposal is contrary to adopted Policy CS6 of the Shropshire Core Strategy and to Government advice contained within the National Planning Policy Framework.

Forton Heath Cottage, Forton Heath, Montford Bridge – 12/04103/OUT

Outline planning application for the erection of a dwelling to include access.

Decision: Approved, subject to a S106 agreement to secure an affordable housing contribution – in accordance with the Officer’s recommendations, subject to the following additional condition: 

No construction (and/or demolition) works shall take place before 7:30am on weekdays and 8am neither on Saturdays nor after 6pm on weekdays and 1pm on Saturdays; nor at any time on Sundays or Bank Holidays. 

Reason:  To protect the amenities of occupiers of nearby properties from potential nuisance.

Residential Development, Land off St Andrews Road, Shrewsbury – 12/04677/FUL

Erection of three detached dwellings; associated parking and double garages.

Decision: Consideration deferred to the next meeting to allow a further opportunity to seek agreement with the applicant for alterations to the orientation/layout of Plot A that would address the concerns of overlooking and loss of privacy expressed by the resident of 22 Worthington Drive.

Land Adjacent 8 Percy Street North, Shrewsbury – 12/05254/FUL

Erection of a detached bungalow with new vehicular access.

Decision: Approved, subject to S106 agreement to secure an affordable housing contribution – in accordance with the Officer’s recommendations, subject to an additional condition requiring the retention of the existing Magnolia tree at the site as part of the development.

1 Red Barn Lane, Shrewsbury – 13/00223/FUL

Change of use of 2 holiday let properties to 2 dwellings.

Decision: Consideration deferred to the next meeting to seek further information from the Highways Officer on the formation of his comments (and ask him to examine if it was possible for a passing place to be provided along the lane); clarification from the applicant of the reason for pursuing the application; request Shrewsbury Town Council to attend to speak to their objections to assist Members in their understanding of the points raised; and for officers to investigate the appropriate level of occupancy at which holiday lets are marketed.

Land off Church Road (Adjacent Manor Court), Uffington – 13/00334/OUT

Outline planning application for the provision of four open market dwellings to include access and layout.

Decision: Approved, subject to S106 agreement to secure an affordable housing contribution – in accordance with the Officer’s recommendations.

Villa Farm, Cardington – 13/00374/FUL

Erection of one wind turbine with a hub height of 18.3 metres and a rotor diameter of 13 metres on a 25sq.m concrete base; demolition of the existing silage tower (amended scheme).

Decision: Approved – in accordance with the Officer’s recommendations.

Montgomerys Tower, Lower Claremont Bank, Shrewsbury – 13/00654/VAR

Variation of condition 1 attached to Planning Permission 12/01260/VAR to allow for a permanent provision of an external seating area. (Amended Description).

Decision: Approved – in accordance with the Officer’s recommendations.
