Decisions made by Central planning committee on 10 September 2015

The following decisions were made by Shropshire Council’s Central planning committee at its meeting at Shirehall, Shrewsbury on Thursday 10 September 2015.

  • Land to the south of Hillside Drive, Shrewsbury (15/02212/FUL) Erection of 25 no. dwellings and associated public open space; formation of vehicular access.  Decision: 

    That planning permission be granted as per the officer’s recommendation, subject to:

    • The conditions as set out in Appendix 1 to the report;
    • A Section 106 Legal Agreement to secure on site affordable housing; and
    • The following additional condition:

    No construction and/or demolition work shall commence outside of the following hours: Monday to Friday 07:30 – 18:00, Saturday 08:00 – 13:00. No works shall take place on Sundays and bank holidays.

    Reason: to protect the health and wellbeing of residents in the area.

  • Former Shrewsbury Sixth Form College, The Tannery, Barker Street, Shrewsbury (15/03009/FUL) Demolition of former Shrewsbury Sixth Form College building known as The Tannery.  Decision: 

    That planning permission be granted as per the officer’s recommendation, subject to:

    • The conditions as set out in Appendix 1 to the report; and
    • The following additional condition:

    No construction and/or demolition work shall commence outside of the following hours: Monday to Friday 07:30 – 18:00, Saturday 08:00 – 13:00. No works shall take place on Sundays and bank holidays.

    Reason: to protect the health and wellbeing of residents in the area.

  • 42 North Street, Shrewsbury (15/02310/FUL) Erection of a single storey rear extension following demolition of existing.  Decision: 

    That planning permission be granted as per the officer’s recommendation, subject to:

    • The conditions as set out in Appendix 1 to the report; and
    • The following additional condition:

    No construction and/or demolition work shall commence outside of the following hours: Monday to Friday 07:30 – 18:00, Saturday 08:00 – 13:00. No works shall take place on Sundays and bank holidays.

    Reason: to protect the health and wellbeing of residents in the area.

  • Land north of Top Farm, Kinton, Shrewsbury (13/05065/OUT) Outline application for the erection of dwelling including re-aligned agricultural access and removal of agricultural shed.  Decision: 

    That planning permission be granted as per the officer’s recommendation, subject to:

    • The conditions as set out in Appendix 1 to the report;
    • A Section 106 Legal Agreement to secure the relevant affordable housing contribution at the Reserved Matters stage; and
    • The following additional condition:

    No construction and/or demolition work shall commence outside of the following hours: Monday to Friday 07:30 – 18:00, Saturday 08:00 – 13:00. No works shall take place on Sundays and bank holidays.

    Reason: to protect the health and wellbeing of residents in the area.

  • Development land adjacent Leylands, Pulley Lane, Bayston Hill, Shrewsbury (14/00254/FUL) Erection of nine dwellings and associated garages; formation of vehicular access.  Decision: 

    That planning permission be granted as per the officer’s recommendation, subject to:

    • The conditions as set out in Appendix 1 to the report;
    • A Section 106 Legal Agreement to secure the relevant on-site affordable housing provision (two shared ownership dwellings); and
    • The following additional condition:

    No construction and/or demolition work shall commence outside of the following hours: Monday to Friday 07:30 – 18:00, Saturday 08:00 – 13:00. No works shall take place on Sundays and bank holidays.

    Reason: to protect the health and well-being of residents in the area.

  • The Fox Inn, Ryton, Shrewsbury (14/00701/FUL) Erection of six residential dwellings.  Decision: 

    That planning permission be granted as per the officer’s recommendation, subject to:

    • The conditions as set out in Appendix 1 to the report; and

    A Section 106 Legal Agreement to secure one on-site affordable dwelling.

  • Development land north of A458, Ford, Shrewsbury (14/01819/OUT) Outline application (access for approval) for mixed residential development.  Decision: 

    That planning permission be granted as per the officer’s recommendation, subject to:

    • The conditions as set out in Appendix 1 to the report;
    • A Section 106 Legal Agreement to secure the relevant affordable housing contribution at the Reserved Matters stage; and
    • The following additional condition:

    No construction and/or demolition work shall commence outside of the following hours: Monday to Friday 07:30 – 18:00, Saturday 08:00 – 13:00. No works shall take place on Sundays and bank holidays.

    Reason: to protect the health and well-being of residents in the area.

  • Land east of Bicton Lane, Bicton, Shrewsbury (14/02239/OUT) Outline application for residential development to include means of access(amended description).  Decision: 

    That, contrary to the officer’s recommendation, planning permission be refused for the following reasons:

  • Development of the proposed site would be contrary to the local development plan policies for the location of housing in both adopted and emerging policy (including SAMDev policy Policy S16.2(vi)).  It is now considered that emerging policy not subject to modification is given significant weight and that there are no other material considerations that would outweigh the conflict with the development plan policies or tip the balance in favour of supporting this proposal; and
  • The site is considered to be situated in open countryside and as the proposal does not fall within any of the exceptions set out in CS5 or any of the special circumstances set out within the NPPF the scheme would result in new housing in the countryside that would be in conflict with Policy CS5 of the Core Strategy and the NPPF.

     

  • Proposed development land north west of Montford Bridge, Shrewsbury (14/02964/OUT) Erection of 8 no. dwellings and formation of new vehicular access off Montford Bridge Road; provision of car parking to serve the existing fishing rights of the site.  Decision: 

    That planning permission be granted as per the officer’s recommendation, subject to:

    • The conditions as set out in Appendix 1 to the report; and

    A Section 106 Legal Agreement to secure the relevant affordable housing provision according to the rate at submission of a Reserved Matters application.

  • Proposed residential development east of Wilcot Lane, Nesscliffe, Shrewsbury (14/03259/OUT) Outline application for proposed housing development (all matters reserved).  Decision: 

    That planning permission be granted as per the officer’s recommendation, subject to:

    • The conditions as set out in Appendix 1 to the report; and

    A Section 106 Legal Agreement to secure the relevant affordable housing contribution at the time of the Reserved Matters application.

  • Land west of Mulberry House, Great Ryton, Shrewsbury (14/03338/OUT) Outline Application for the erection of 2No dwellings (to include access).  Decision: 

    That planning permission be granted as per the officer’s recommendation, subject to:

    • The conditions as set out in Appendix 1 to the report; and

    A Section 106 Legal Agreement to secure the relevant affordable housing contribution at the time of the Reserved Matters application.

  • Proposed residential development opposite The Crescent, Nesscliffe, Shrewsbury (14/03357/OUT) Outline application for the erection of up to 39 residential dwellings; change of use of land for community development serviced site; school drop-off / pick-up facility; with open space landscaping buffer (to include access).  Decision: 

    That planning permission be granted as per the officer’s recommendation, subject to:

    • The conditions as set out in Appendix 1 to the report; and

    A Section 106 Legal Agreement to secure the relevant affordable housing contribution at the time of the Reserved Matters application.

  • Land off Horsebridge Road, Minsterley, Shrewsbury (14/03670/OUT) Outline application for residential development of 15 No dwellings (to include access).  Decision: 

    That planning permission be granted as per the officer’s recommendation, subject to:

    • The conditions as set out in Appendix 1 to the report;
    • A Section 106 Legal Agreement to secure the relevant affordable housing contribution at the time of the Reserved Matters application; and
    • The following additional conditions:
  • No construction and/or demolition work shall commence outside of the following hours: Monday to Friday 07:30 – 18:00, Saturday 08:00 – 13:00. No works shall take place on Sundays and bank holidays.
  • Reason: to protect the health and well-being of residents in the area.

    That the number of dwellings on this site be limited to no more than 15 dwellings.

  • Proposed development land west of 12 Little Minsterley, Minsterley, Shrewsbury (14/00808/FUL) Erection of 1no: detached bungalow and 1no: detached 2 storey dwelling; including 2 detached garages, car parking and associated landscaping.  Decision: 

    That planning permission be granted as per the officer’s recommendation, subject to:

    • The conditions as set out in Appendix 1 to the report; and

    A Section 106 Legal Agreement to secure the relevant affordable housing contribution at the time of the Reserved Matters application.
